Enoch Burke seeks stay on school proceedings over injunction

By Tadhg O'Sullivan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Enoch Burke’s application to attend the High Court to seek a stay on proceedings brought by Wilson’s Hospital School was refused on 24 October 2022. Justice Brian O’Moore adjourned the application to 7 November.

Burke sought to delay the full dispute until the Court of Appeal decides his appeal against a High Court injunction requiring him to stay away from and not teach at the school in Co Westmeath. The appeal was listed for February, while no date had been fixed for the full High Court hearing.

The judge said the school needed sufficient notice of the stay application and that a few hours’ notice was too short. He also cited pressure on the Chancery Court list, and said Burke could apply for a stay in the normal manner.
