Gerard Maher loses drink-driving appeal over breath test

By Rory Hanlon

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Gerard Maher’s appeal against his conviction for driving while intoxicated was dismissed by the Court of Appeal on 17 July 2019. He had been arrested after being observed driving erratically and provided breath specimens at Mullingar Garda station on 25 October 2015.

The court held that the relevant regulations did not require Gardaí to offer a choice between Irish and English for the breathalyser statements. It found no statutory basis for excluding the statements, and dismissed the appeal against Maher’s conviction and consequential driving disqualification.
