Dublin man’s sexual assault conviction quashed on appeal

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

An unnamed Dublin man’s sexual assault conviction was quashed by the Court of Appeal on 12 May 2022; his three-year-and-four-month sentence was set aside with it.

The conviction followed a jury trial at Dublin Circuit Criminal Court, where he had pleaded not guilty to sexually assaulting his nine-year-old daughter at their Dublin home between 1 January and 30 April 2017.

The appeal court found the jury needed further assistance on whether the man was awake or asleep, and said it had doubt about whether the verdict was safe. It quashed the conviction on that ground.

The court dismissed a separate appeal ground concerning corroboration. After judgment, the case was adjourned for one week and the man was remanded on bail on condition he not contact the complainant.

This report covers an earlier stage of the case. Later developments are not reported here.
