Court of Appeal replaces James Varian’s suspended sentences with prison terms

By Cathal Brosnan

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

The Court of Appeal quashed James Varian’s fully suspended sentences and resentenced him to four years in custody for facilitating the sexual exploitation of a child, with the final 12 months suspended for 12 months. It imposed a concurrent two-year custody term for possessing child abuse images.

The court found the original decision to suspend the sentences in full was outside the norm and unduly lenient. It accepted the original sentencing judge’s two-year reductions for mitigation on each count. The Director of Public Prosecutions had appealed the original sentence as too lenient.
