Cork council wins leave to challenge development plan direction

By Eimear Byrne

This report is a localnews.ie summary based on public court reporting and records; sources are listed below.

Cork County Council was granted leave to challenge a direction on its development plan in the High Court on 15 March 2021. The direction required the council to remove a variation allowing for a potential major retail outlet centre in the Cork metropolitan area.

Mr Justice Charles Meenan granted the council’s ex-parte application and returned the matter to the following month. The council claims the Minister’s decision was unlawful and seeks orders quashing the direction, along with declarations concerning provisions of planning legislation.
