The Labour Court allowed Boston Scientific’s appeal and set aside an earlier finding that Paul Sheehan’s unfair dismissal complaint was well founded. The decision was dated 7 March 2024. Sheehan argued that his service as an agency worker at the company’s site should count towards the time he worked directly for Boston Scientific. The Court found that his agency contract ended on 5 July 2019 and his direct employment began on 6 July 2019. It ruled that the law did not carry his agency service into the later contract with a different employer. Because he had less than one year’s continuous service with Boston Scientific when it dismissed him, he could not bring the complaint.
