The Labour Court has overturned an unfair dismissal decision in favour of Cameron Scott, finding Aldi Stores (Ireland) Limited had substantial grounds to dismiss him for gross misconduct. The Court set aside the Adjudication Officer’s decision after allowing Aldi’s appeal.
Scott worked for Aldi from January 2020 until he was dismissed without notice in May 2021. The Court considered repeated incidents in which he took food or drinks without paying, as well as abusive language towards managers.
Scott said he intended to pay for the goods but forgot because of his condition or medication. Aldi relied on its workplace policies and occupational health reports, which did not attribute the repeated failures to pay to forgetfulness.
The Court found that the incidents were undisputed and Aldi’s disciplinary procedures were fair. It concluded that dismissal was within the range of responses a reasonable employer could take. In plain terms, the Court found Aldi had grounds to dismiss Scott.
The determination was signed on behalf of the Labour Court on 28 February 2023.
