The Labour Court increased Ann-Marie Nulty’s unfair-dismissal compensation from €4,000 to €5,000 on Blackrock Leisure Limited T/A Blackrock Leisure’s appeal. The determination was signed on 30 August 2019.
The company disputed Nulty’s employment start date and argued she lacked the service needed to bring a claim. The Court accepted her evidence that she started on 2 September 2015, relying on her testimony and a November 2015 photograph.
The Court found she was dismissed without an investigation, advance notice that dismissal was being considered, a chance to prepare a defence, representation, consideration of alternatives or an appeal. It found the dismissal unfair and assessed compensation based on her earnings and subsequent work.
