The Labour Court upheld the finding that Margaret Doyle was unfairly dismissed and reduced her compensation from €15,000 to €10,000 on An Clochán Liath Pub Limited’s appeal. The determination was dated 1 August 2019.

Doyle worked as a chef and kitchen worker at The Stepping Stone. She was told in February 2018 that she was redundant and received statutory redundancy pay. The company argued that Playside Limited had stopped trading and that the new company operated a changed business. Doyle said the business continued in substantially the same form.

The Court found that the pub and restaurant resumed similar activities under the same trading name, retaining the business’s identity after a lease transfer. It concluded Doyle’s employment rights should have transferred to the new company and that she should not have been made redundant. The Court set compensation at €10,000 after considering her losses and efforts to limit them.
