The Labour Court upheld Mr Darwesh Karim trading as Family Market’s appeal and overturned the €5,000 compensation award to David Morris in his unfair dismissal case. In a determination signed 15 December 2017, the Court found Morris had not established that he was dismissed and found his complaint not well founded.
Morris said he was told by text that he was sacked after a dispute about mopping the shop floor at the end of his shift. Karim denied sending a dismissal text and said Morris left the shop and did not return for his next shift. The Court preferred the employer’s evidence and set aside the Adjudication Officer’s decision.
