The Labour Court rejected a worker’s unfair-dismissal appeal, finding that he had resigned, but upheld his holiday-pay complaint and affirmed a €120 award. It also found his claim for pay in lieu of notice was not well founded. The Court dated its determination 15 May 2017. The worker said the company’s managing director, his father, dismissed him after an argument about signing payroll cheques. The company said the outburst was not intended as a dismissal and that the worker had left a resignation letter. The Court preferred evidence that he had been seeking other work and found that he resigned. It also found the company had failed to produce required records of annual and public holiday payments.
