Labour Court finds union complaint against Pat Maher well founded

The Labour Court found the Services Industrial Professional Technical Union’s complaint against Mr Pat Maher, trading as Pat Maher Ltd, well founded over the company’s failure to enrol all employees in a compliant construction industry pension, assurance and sick-pay scheme. The decision was signed on 22 December 2005. The company said it had a pension and sick-pay scheme but acknowledged that not all employees were enrolled. The Court found that the scheme did not provide the required retirement, mortality or sick-pay benefits, that employee contributions exceeded those specified by the agreement, and that the agreement required all employees to be enrolled. The Court deferred making a further order for one month to allow discussions on bringing the company into compliance.
