Labour Court finds carpenters working for Patrick McKevitt covered by agreement

The Labour Court found a complaint by the Building And Allied Trades Union well founded, ruling that carpenters who personally provided services to Patrick McKevitt and Flagstaff Ltd were workers covered by the construction industry pensions, assurance and sick-pay agreement. The decision was dated 22 December 2005. The respondent argued the carpenters were self-employed contractors and not workers under the agreement. The Court found that people providing services personally were covered, whether engaged under a contract for services or a contract of service. The Court deferred deciding what order to make for one month to allow the parties to seek agreement.
