Labour Court recommends HSE worker use grievance procedures over Grade VIII duties

The Labour Court has recommended that the Health Service Executive and a Grade VII Business Manager use their workplace procedures to address his claim that he carried out Grade VIII duties while paid at Grade VII. The recommendation was signed on 24 August 2026.

The worker said he performed Grade VIII work from April 2018 to June 2025. The HSE disputed his account that his grievance had been upheld: the first stage rejected it, while a second-stage appeal said his request for regrading merited consideration. The Court said that process was incomplete because a business case was still required.

The Court noted that he had bypassed the final stage of the HSE grievance procedure and no longer performed the disputed duties. It recommended that the parties use the established procedures fairly and promptly. It did not recommend compensation.
