Labour Court upholds €5,000 recommendation over Garda bullying complaint delay

The Labour Court upheld a €5,000 recommendation to a worker over delays in investigating her bullying complaint against An Garda Síochána. The determination was signed on 21 May 2026. The worker submitted the complaint in March 2023. The investigation policy provided for an investigator to be appointed within 10 days where mediation was not accepted, but the first investigator was appointed in June and a second in October. The worker’s bullying complaint was not itself upheld, although an independent expert identified shortcomings in the investigation process. The Court noted that both parties accepted the investigation had taken exceptionally long and saw no basis to depart from the Adjudication Officer’s recommendation for the delay.
