The Labour Court set aside an adjudication officer’s recommendation in a dispute between Bidvest Noonan and a worker over access to an income protection scheme. The Court’s decision was dated 16 December 2024. The worker appealed after the adjudication officer declined to recommend reinstating a scheme available through her former employer or compensation. Bidvest Noonan had agreed with SIPTU to investigate providing an income continuance policy after the worker transferred to the company in 2020, but found the cost prohibitively expensive. The Labour Court said the issue affected a body of workers and was collective in nature, so it was not properly before the Court under section 13.
