The Labour Court rejected the unions’ claim for disturbance payments for transient staff after Balfour Beatty CLG moved its depot from Merrywell to Brownsbarn. The recommendation was signed on 5 May 2017. The Technical, Engineering and Electrical Union and the Services Industrial Professional Technical Union sought compensation for extra travel time, changes to personal circumstances and wear on workers’ own vehicles. The dispute before the Court concerned transient staff who were not permanently based at the depot and used company vehicles. Balfour Beatty had clarified an allowance offer for staff permanently based at the depot. The Court concluded that an allowance was not warranted for transient staff and rejected the unions’ claim. It made the recommendation under the Industrial Relations Act 1990.
