Labour Court recommends €1,404 payment and restored duties for Shaws worker

The Labour Court recommended that Shaw & Sons Ltd T/A Shaws Department Stores restore an anonymised worker’s management cover and key-holding duties from 1 January 2017, and pay her €1,404 for the period from December 2015 to 31 December 2016. The recommendation was signed on 19 December 2016 after the employer appealed an adjudication officer’s decision. The employer said it should decide who was in charge of its premises, stock and personnel. Mandate sought the worker’s restoration to her former duties. The Court accepted the employer could decide who was in charge, but found the events described did not justify completely undermining its confidence in the worker’s ability to carry out management cover or key-holding duties.
