The Labour Court affirmed the recommendation that Health Service Executive NW pay Mary Mc Anaw €2,500 as a goodwill gesture recognising procedural deficiencies in handling her workplace grievance. The decision was dated 29 November 2016. Mc Anaw, represented by the Irish Nurses Organisation, appealed the Rights Commissioner’s recommendation. The Labour Court supported findings that the grievance process had procedural deficiencies, including denying her an appeal from the stage two outcome and delays in handling the complaint. The Court made no finding on her contention that the person assigned to conduct the stage two appeal had a conflict of interest. It recommended that the Adjudication Officer’s decision be accepted and affirmed it.
