The Labour Court recommended that a worker at Tesco Ireland be placed in the store-based hours band for more than 35 hours but less than full time. It also recommended that he remain free to apply for a future Dot Com Delivery Assistant vacancy. The recommendation was signed on 14 September 2016, following an appeal brought by Mandate on the worker’s behalf. The worker had sought reinstatement as a Dot Com Delivery Customer Assistant, restoration of his original pay and removal of a final written warning. Tesco Ireland Limited Trading As Tesco Ireland said he had made 21 unauthorised delivery stops and failed to report three customer orders that were not delivered. The Court said he repeated conduct after concerns were raised and accepted that trust mattered in a role with limited direct supervision. It considered the penalty reasonable but found the continued reduction in hours disproportionate.
