The Labour Court recommended that the Services Industrial Professional Technical Union reconsider and accept MSD Rathdrum’s competitiveness plan, with an added safeguard requiring the company to engage with the union before future outsourcing decisions. The recommendation was signed on 29 August 2012. The dispute concerned pay increases, the outsourcing of waste handling and safeguards for future outsourcing at the Rathdrum plant. The Court found the proposed pay increases and voucher payments fair, accepted that the company’s proposal to deploy one additional Indaver worker to waste handling was in line with the existing agreement, and recommended the safeguard on future outsourcing.
