The Labour Court recommended that St Johns Hospital and the INMO return to their pre-2009 arrangement for theatre nurses required to stay after 5pm, or apply the National Agreement, then negotiate future arrangements. The recommendation was signed on 16 June 2011. The earlier local arrangement provided €84.68 in time off in lieu when a nurse stayed to finish a theatre case. The Court said the parties had negotiated at cross-purposes in 2009 and had not reached a valid agreement because their understandings differed substantially.
