The Labour Court recommended that Rehab Group fund an alternative representative of an employee’s choice if it considered the employee’s chosen representative unacceptable. It also recommended that the disciplinary investigation be carried out expeditiously. The recommendation was signed on 2 February 2011. The employee said Rehab Group had refused to let his chosen representative continue in a disciplinary investigation and sought the reinstatement of that representative. The Court considered the employee entitled to representation by a person of his choice and recommended that the investigation proceed under the employer’s procedures where consistent with the Code of Practice.
