The Labour Court found Lufthansa Technik Airmotive Ireland Limited in breach of the Towards 2016 agreement after it withheld the final 2.5% pay increase due from 1 July 2009. In a recommendation signed on 24 June 2010, the Court said the company had neither negotiated over the increase nor invoked the agreement’s inability-to-pay or cost-offsetting clauses. The Technical, Engineering and Electrical Union said the company had to pay the increase or invoke those clauses. The company said difficult trading conditions prevented immediate payment, but it intended to pay and might seek to spread the increase over a longer period.
