The Labour Court recommended no change to Conoco Phillips Whitegate Refinery Ltd’s arrangement for compensating shift supervisors and process leaders who worked public holidays. The recommendation was signed on 21 June 2010. The Employees of Conoco Phillips Whitegate Refinery Ltd, represented by Unite, argued that public-holiday work warranted compensation beyond the statutory minimum. The company said its rota provided the statutory entitlements and additional paid time off. The Court said the arrangement, introduced in 2000, compensated holiday work with time off in lieu for the hours worked rather than a premium rate, and saw no basis for change.
