The Labour Court did not recommend that the Health Service Executive concede a worker’s claim to return to work after resigning from Mount Alvernia Hospital. The recommendation was signed on 29 June 2009. The worker, who had been an attendant at the hospital, said he resigned under duress and asked to return after more than 12 years’ service. The HSE said he resigned voluntarily and had been treated fairly. The Court found that he resigned and confirmed his resignation, and that the HSE acted reasonably in trying to address the situation. It found against the worker and did not recommend conceding the claim.
