The Labour Court recommended that Mayo County Council pay a retained firefighter for lost earnings from 23 August 2002 to 30 June 2003, citing exceptional circumstances around his retirement. The recommendation was signed on 16 April 2008. The Court said the Council had correctly applied the national pension-gratuity rules and did not recommend extending the benefit for service beyond age 58. But a moratorium on retirement applied to firefighters who had reached retirement age, and the Court recommended payment for the worker’s lost earnings during that period. The Services Industrial Professional Technical Union had also argued that he was not told about developments in the retirement-age rules.
