The Labour Court recommended that Johnson Mooney & O'Brien pay a worker €10,000 and reinstate him after finding his dismissal grossly unfair. The recommendation was issued on 11 December 2007.
The worker was dismissed after refusing to apologise to a factory manager following a disagreement over a work request made during his break. The company said he had refused a valid instruction and that fair procedures had been followed. It did not attend the hearing but sent a written statement.
The Court said the worker had made great efforts to limit his losses and recommended compensation and reinstatement in his previous job.
