The Labour Court recommended that the HSE should not concede the Services Industrial Professional Technical Union’s claim to apply 97% of the construction industry craft rate to a general operative in its South Cork Mobile Unit. Dated 25 April 2007, the recommendation said the worker was not required by their employment conditions to work beyond the duties in their job description and relevant agreements. The union said the worker performed the same duties as colleagues paid the higher rate. The HSE said the worker was paid according to their contract and that differentials for certain duties were maintained on a personal-to-holder basis.
