The Labour Court recommended that Musgraves Supervalu-Centra admit three qualifying employees to its former defined benefit pension scheme for the relevant period before it closed. The recommendation was signed on 25 April 2007. Services Industrial Professional Technical Union (SIPTU) argued that five workers should have been made permanent earlier and included retrospectively in the scheme. The company said seniority was not the only criterion for permanent appointments and that the workers were members of its current defined contribution scheme. The Court accepted that the parties had misunderstood when a 2002 agreement ended the use of seniority as a criterion.
