The Labour Court recommended that Trinity College continue paying two workers a 7.5% allowance after they lost it when returning from career breaks to different creche positions. The recommendation was signed on 26 January 2006.
The workers had sought to return to their former Montessori posts. Trinity College said their return to those posts was not guaranteed and the allowance did not apply outside the Montessori section. The Court said they could reasonably have expected to return at the same pay level, but the former posts had been permanently filled. It recommended continuing the allowance on a red-circled basis and assigning them by seniority to future Montessori vacancies.
