The Labour Court recommended that An Post reclassify a worker’s absence as sick leave after finding the company had no authority to place her on a career break without her consent. The recommendation was signed on 24 October 2005. The worker returned after a career break ended on 11 October 2004, then became unable to work because of illness. An Post later restored her career-break status. The Court did not recommend restoring her full sick-pay benefits, saying management could use its discretion over the duration of paid sick leave in the circumstances.
