The Labour Court found that Dunnes Stores Tralee breached the disciplinary procedures Code by refusing three workers their chosen trade union representation. In a recommendation signed on 1 November 2005, it said employees must be allowed to choose between representation by a colleague and a registered trade union. Mandate said management cancelled disciplinary meetings after the workers attended with a union official. The company said its procedures allowed representation by a colleague or friend and denied breaching the Code. The Court concluded that the choice of representative belonged to the employee, and recommended that the company amend its procedures accordingly.
