The Labour Court recommended that Medical Recruitment Specialists offer a worker re-employment on her former terms if she accepted a clearly set out procedure for patient incidents. The recommendation was dated 30 November 2004. If she resumed work, she was to receive €300 in full and final settlement of all claims.
The worker said a patient grabbed her by the neck while she was working at St Vincent’s Hospital and that she received inadequate support afterwards. The Court did not accept that the end of her employment amounted to constructive dismissal, but said the employer shared responsibility for failing to explain the procedure adequately.
