The Labour Court recommended that Rotunda Hospital offer a Grade 4 clerical worker €3,000 in full and final settlement of outstanding claims concerning higher duties and job evaluation. The Court accepted that the worker had performed duties above her grade, though the extent and duration were disputed.
The Services Industrial Professional Technical Union said the worker’s post had not been properly evaluated and sought the difference between Grade 4 and Grade 5 pay from 1999 to September 2003. The hospital said its evaluation exercise examined positions and departmental structures rather than individuals, and argued that the worker had not taken on all Grade 5 responsibilities.
The Court noted that the union was not then pursuing a re-evaluation of the post. It recommended that the hospital offer the lump sum and that the union accept it in full and final settlement. The recommendation was signed on 9 August 2004.
