The Labour Court rejected the Automobile General Engineering & Mechanical Operative Union (AGEMO)'s claim for improved pay and conditions for quarry workers and truck drivers at Tracey Enterprises. In its recommendation, dated 24 March 2004, the Court found the claim breached the Sustaining Progress agreement and recommended that the parties meet to discuss the issues once litigation involving the company was clarified. The union said members' pay and conditions had fallen behind those in quarrying and construction. Tracey Enterprises cited uncertainty from litigation and said it was prepared to discuss the issues after the proceedings concluded.
