The Labour Court recommended a revised formula for compensating permanent staff at Udv Operations Ireland Limited for lost overtime opportunities after a night shift was introduced. The recommendation was dated 29 April 2002. The Services Industrial Professional Technical Union sought compensation of 2.5 to 3.5 times annual losses. The company said overtime was voluntary, some opportunities would remain and it had offered a lump sum based on earlier overtime. The Court considered the company’s approach fair and reasonable, but recommended calculating the loss from average overtime in the three years before the shift, offsetting overtime available in the first full year afterwards, then multiplying the resulting yearly loss by two.
