In 2000, the Labour Court recommended that Eastern Regional Health Authority and Irish Nurses Organisation await an ICTU decision on the union's negotiating rights at St Joseph's Learning Disability Services, then review the dispute. The recommendation was signed on 17 November 2000. The union sought to have registered nurses of the mentally handicapped included in competitions for supervisory nursing posts. The Authority said it would not intervene while the union representation issue was before ICTU. The Court said it could not recommend on the substance of the claim until negotiating rights were determined.
