Labour Court found Dargle Cabs worker was not constructively dismissed

In 1998, the Labour Court found that a worker was not constructively dismissed by Dargle Cabs after a dispute over shift patterns. The recommendation was dated 11 September 1998. The worker said shifts changed without consultation and that he felt unable to continue working for the company. Dargle Cabs said an agreement provided for equal rotation and that the worker later asked to work night shifts only. The Court found he had not shown that the company’s conduct left him no reasonable alternative but to resign.
