The Labour Court rejected a worker’s appeal against Dublin Corporation’s disciplinary decision after an altercation at a cleansing depot. In a recommendation dated 5 November 1997, the Court found no grounds to amend the Corporation’s decision. The worker had been placed on leave without pay, demoted to Overseer Grade I and transferred. The Corporation later reduced his promotion ban and final warning to six months each. He argued the penalty was excessive and that he had not been given a fair chance to challenge the complaint or witnesses. The Corporation said it had considered his service record but could not condone physical violence at work.
