In 1994, the Labour Court recommended that Kylemore Bakery pay a general operative one week’s salary after finding the company had not followed its handbook procedure for dismissal. The recommendation was dated 13 October 1994. The bakery said the worker was dismissed during probation and gave written reasons including attendance and performance. He disputed the allegations, said he had received no warning and said he was dismissed while on certified sick leave after a workplace injury. The Court found the bakery had not acted unreasonably in dismissing him under the probation terms of his contract, but had failed to follow the procedure in its handbook. It recommended payment equivalent to one week’s salary.
