Labour Court recommends revised compensation formula for Thermos King Europe shift workers

In 1993, the Labour Court recommended revised compensation for workers affected by the end of the evening shift at Thermos King Europe. Workers with up to 12 months on shift would receive no compensation; those with 12 to 36 months would receive nine months’ compensation, and those with more than 36 months would receive 18 months’ compensation. The formula covered permanent evening-shift workers moving to day work and day workers receiving the shift premium. It excluded day workers with the potential to work shifts and temporary workers. The Amalgamated Engineering And Electrical Union sought compensation for lost earnings. Thermos King Europe said the evening shift ended because business had declined and opposed compensating day workers who swapped shifts. The recommendation was dated 29 November 1993.
