The Labour Court recommended that O'Driscoll O'Neill Limited pay a worker dismissed from her receptionist job an ex-gratia amount equal to three months’ salary, in addition to her contractual entitlements. The recommendation was dated 20 September 1993. The Court found she had been harshly and unfairly treated, particularly because the company had not applied its disciplinary procedure. It also said there had been no in-depth examination of why her performance fell short or whether the standards were realistic for the job. The company said it received customer complaints, raised performance concerns and offered further training, which the worker declined.
