In 1993, the Labour Court found no grounds to recommend that Dublin Corporation concede a constructive dismissal claim brought through the Services Industrial Professional Technical Union. The recommendation was dated 1 September 1993. The union said the worker had given good service, regretted resigning and promptly sought reinstatement. Dublin Corporation said he had resigned voluntarily to take a job abroad and that his service had not been generally satisfactory. The Court considered the parties’ submissions and said the claim failed.
