The Labour Court recommended that An Post pay two dismissed temporary postmen in full through the scheduled end of their contracts, after finding the evidence against them insufficient to justify their dismissal. The recommendation was dated 27 July 1993.
The dispute followed allegations that one postman assaulted a colleague and the other verbally threatened him. Both denied involvement. An Post investigated and upheld their dismissals; the Communications Workers Union argued the evidence was inadequate and procedures had not given the men a fair chance to answer the allegations.
The Court found conflicting evidence about what happened and called management’s decision unsafe. It recommended payment through 19 April 1993, the scheduled end of the workers’ contracts, in full and final settlement of their claims. The union had sought reinstatement or compensation for lost earnings, but the Court recommended payment only through the contract end date.
