In 1992, the Labour Court recommended that Federal Express recognise the Marine Port And General Workers Union for employees it had in membership. The recommendation was signed on 28 February 1992. The union sought recognition after saying Federal Express had refused to meet it or discuss two members' dismissals. Federal Express said the workers' contract was being renegotiated and it would look favourably on recognition if it retained the contract. The union had agreed to be bound by the recommendation. Federal Express did not attend the hearing but sent the Court a letter setting out its position.
