The Labour Court recommended that Ballyfree Farms Limited offer a worker the first suitable vacancy on a probationary basis after considering her unfair dismissal claim. Its recommendation was dated 21 January 1992. The worker said she was told her six-month probation was a trial period and that she was being let go because of a temporary shortage of work. Ballyfree Farms said she was unsuitable for permanent employment and her attendance was unreliable. The Court found conflicting evidence and gave the worker the benefit of the doubt.
