In 1990, the Labour Court recommended that the Services Industrial Professional Technical Union accept Braun Ireland Limited’s proposal for handling two workers’ claims under its disablement benefit plan. The recommendation was signed on 5 November 1990. The two workers had been refused benefits while pursuing third-party claims after separate car accidents. The Court considered the company’s proposed method fair and reasonable: solicitors would include plan payments in the third-party claims, with repayment to the fund if those claims succeeded. It also recommended that the parties clarify the scheme clauses that had caused uncertainty.
