In 1988, the Labour Court recommended an ex gratia payment of £400 each for two former employees of Rowntree Mackintosh (Ireland) PLC. The recommendation was signed on 11 May 1988. The Court found they were not entitled to the redundancy package agreed with the unions, but said they had not been clearly told their employment had ended. The Federated Workers' Union Of Ireland sought the enhanced terms, arguing illness had prevented the employees from returning when recalled. The company said they were temporary workers who were removed from its lists when they could not take up offered work.
