The WRC recommended that a gym pay a worker €2,000 after finding that it had not given her clear written warnings or enough time to improve before dismissing her during probation. The recommendation was dated 11 September 2025.
The fitness instructor said she had not known her performance was in question until a review about four weeks into the job. The gym said staff and members had complained about her coaching, conduct and attention to safety, and that it had given her guidance. The adjudication officer found there was no employment contract or formal written record setting out performance concerns or warning that her job was at risk. She found the worker had only a further week to improve before recommending compensation equivalent to four weeks' pay under section 13 of the Industrial Relations Act 1969.
